暗夜的哭聲
長久以來，法律專業界的文化對其道德非難的力量始終抱持懷疑的態度。法官及一般的陪審員，越來越不願責難呈現在他們眼前極為明顯的惡行。過去五十年來，充滿自信的精神病學專業崛起，法官及法律評論者開始認為，他們不再有方法或智識去瞭解為何人們會犯下暴力罪行。在暴力犯罪中，浮現在事件外表，以及人們想像中的情形，都並非「真實」。為了知道並瞭解發生的事情的真相，我們必須考量嫌疑犯的內在狀態。人們必須了解他的心智狀態，及其精神病史。這個時代不再將犯罪視為邪惡的表現，而是心智疾病造成的行為。 精神病學家成為辨識心智的專家，而犯罪似乎與精神異常有關。理智的人、正常的人是不會犯罪的。因此，若沒有專家有關心智偏差的報告，我們便無法判斷、評價、處罰犯罪行為。結果是，處理有關犯罪及處罰問題的權力逐漸從政府機關移轉到私人的精神病學家手上。我們共同的道德判斷經歷此種未察知的「私有化」過程，這意謂著領有酬勞的精神病學家正成為刑事審判中判斷有罪、無罪的關鍵角色。在丹．懷特的審判中，就如我們可以發現的情況，大多數的證詞均來自於六位受領薪資的專家，他們負責檢查被告的精神狀態，並就被告的內在心智提出報告。 依賴私人專家的趨勢，有一個危險，正如法國俗諺所說：「理解一切即寬恕一切。」（Tout comprendre, c'est tout pardonner）當你愈瞭解一個人的犯罪理由時，你便越不想責難他。一旦你越將丹．懷特行為放在他個人精神狀態歷程的脈絡中來理解時，你便愈不願指責他的行為是惡的，也不願懲罰他，以顯現我們共同的不贊許。一九五○及一九六○年代時，主要的刑法思潮傾向盡可能不再強調責備，並將精神病學專業引入法庭。經由如此的轉化，犯罪成為「偏差行為」，懲罰變成「治療」。審判的功能不再是尋求犯罪事實、懲罰犯罪，而是瞭解嫌疑犯的心智。 資料來源:
